Please read these terms carefully before using our services. By accessing or using Credit Checkr, you agree to be bound by these terms.

These Terms of Service ("Terms") govern your access to and use of the Credit Checkr website, services, and products (collectively, the "Services"). These Terms constitute a legally binding agreement between you and Credit Checkr ("we," "our," or "us").

Important: Please read these Terms carefully. By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not access or use our Services.

Acceptance of Terms

By registering for an account, accessing our website, or engaging our credit repair services, you agree to comply with and be legally bound by these Terms. You also agree to comply with all applicable federal, state, and local laws, including the Credit Repair Organizations Act (CROA) and Fair Credit Reporting Act (FCRA).

If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

Description of Services

Credit Checkr provides credit repair and restoration services, including but not limited to:

  • Analysis of credit reports from major credit bureaus
  • Identification of inaccurate, outdated, or unverifiable negative items
  • Preparation and submission of dispute letters to credit bureaus and creditors
  • Monitoring of credit report changes and dispute outcomes
  • Credit building education and guidance
  • Ongoing customer support and consultation

CROA Disclosure: You have the right to dispute inaccurate information in your credit report yourself, at no cost, by contacting the credit bureaus directly. You may cancel this contract without penalty or obligation within 3 business days from the date you sign it. We do not guarantee specific results or score improvements.

Eligibility and Account Registration

To use our Services, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding contract
  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your account credentials

You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use of your account or any other security breach.

Service Fees and Payment

Pricing: Service fees will be clearly disclosed before you enter into any service agreement. Fees may vary based on the complexity of your case and services selected.

Payment Terms: You agree to pay all fees associated with your selected services. Payment is due according to the billing schedule agreed upon in your service contract.

Cancellation and Refunds: You may cancel services at any time without penalty. Refund policies, if applicable, will be outlined in your service agreement and comply with all CROA requirements.

Late Payments: Failure to pay fees may result in suspension or termination of services. We reserve the right to charge late fees or interest on overdue amounts as permitted by law.

No Guarantees or Warranties

While we strive to provide excellent service and achieve positive results, we cannot and do not guarantee:

  • Specific credit score increases or improvements
  • Removal of any particular negative item from your credit report
  • Any specific timeline for results
  • Approval for credit, loans, or other financial products

Credit repair results vary based on individual circumstances, the accuracy of negative items, and credit bureau responses. Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied.

Federal Law Notice: Any credit repair organization that promises specific results or guarantees credit score improvements is violating federal law. We operate in full compliance with CROA and provide realistic expectations based on your unique situation.

Your Responsibilities

As a client, you agree to:

  • Provide accurate, complete, and truthful information
  • Respond promptly to requests for information or documentation
  • Notify us of any changes to your contact information or credit situation
  • Refrain from making false statements or misrepresenting facts
  • Not dispute accurate information on your credit reports
  • Follow credit-building recommendations and guidance
  • Maintain payment obligations during active service

Failure to fulfill these responsibilities may affect our ability to provide effective services and could result in termination of services.

Prohibited Activities

You agree not to:

  • Use our Services for any illegal purpose or in violation of any laws
  • Provide false, inaccurate, or misleading information
  • Attempt to dispute accurate information on credit reports
  • Impersonate another person or misrepresent your identity
  • Interfere with or disrupt our Services or servers
  • Attempt to gain unauthorized access to our systems
  • Use automated systems (bots, scripts) to access our Services
  • Reproduce, distribute, or create derivative works from our content without permission
  • Violate the intellectual property rights of Credit Checkr or third parties
  • Engage in any activity that could damage our reputation or business

Intellectual Property Rights

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, images, software, and design, are owned by Credit Checkr or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works, publicly display, republish, download, store, or transmit any material from our Services without our prior written consent, except for your personal, non-commercial use.

Limitation of Liability

To the fullest extent permitted by law, Credit Checkr and its officers, directors, employees, and agents shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damage to credit scores or credit reports resulting from actions by third parties
  • Denial of credit applications or financial products
  • Delays or failures in credit bureau responses
  • Actions or inactions of credit bureaus, creditors, or other third parties

Our total liability to you for any claims arising from or related to our Services shall not exceed the total amount you paid to us for Services during the 12 months preceding the claim.

Note: Some jurisdictions do not allow limitations on implied warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless Credit Checkr and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of our Services, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) any false or misleading information you provide to us.

Termination

By You: You may terminate your account and cancel our Services at any time by contacting us in writing. Cancellation will be effective according to the terms of your service agreement.

By Us: We may suspend or terminate your access to our Services immediately, without prior notice or liability, for any reason, including:

  • Breach of these Terms
  • Providing false or misleading information
  • Engagement in fraudulent or illegal activities
  • Non-payment of fees
  • At our sole discretion if we believe termination is necessary

Upon termination, your right to use our Services will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimer of warranties, and limitation of liability.

Dispute Resolution and Arbitration

Informal Resolution: If you have a dispute with us, you agree to first contact us at [email protected] and attempt to resolve the dispute informally.

Arbitration Agreement: Any dispute that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the state where you reside or another mutually agreed location.

Class Action Waiver: You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action, consolidated action, or representative action.

Exceptions: Either party may seek injunctive or other equitable relief in court to protect intellectual property rights or confidential information.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Credit Checkr is headquartered, without regard to conflict of law principles. You agree to submit to the personal jurisdiction of courts located in that state for any actions not subject to arbitration.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on our website with a new "Last Updated" date
  • Sending email notification to your registered email address
  • Displaying a prominent notice on our website

Your continued use of our Services after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using our Services and may cancel your account.

Miscellaneous Provisions

Entire Agreement: These Terms, together with our Privacy Policy and any service agreement, constitute the entire agreement between you and Credit Checkr.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Waiver: No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.
